The sultan then was controlled by the Dutch since the Dutch endorsed him as the Sultan in 1818. Tengku Hussein was the eldest son of the previous Sultan, however he was away at Parang when his father died, thus his brother claimed the position of the Sultan. Though many malay officials who were Tengku Hussein's supports were against this, they couldn't do anything since the Dutch was too powerful for them.
When Raffles arrived at Singapore and wanted to establish a port in Singapore, he couldn't ask the Sultan to sign the treaty since he was controlled by the Dutch, and the Dutch obviously wouldn't allow it. Hence, when raffles promised to recognise tengku hussein as the rightful sultan of Johor and Singapre in the condition that Tengku Hussein sign the treaty which allow him to establish a port in Singapore and to colonise Singapore.
