The prime purpose of copulation is to fertilize eggs with sperm and there is little point (from a biological viewpoint) of copulating when the female is not in heat as there are no eggs available to be fertilized.

The female not only has to be in heat but she will only throw that scent off 3 days out of the 3 weeks she is in heat. So unless she is throwing off that scent, then and only then will they mate.
