It's to do with the Children's Online Privacy Protection Act of 1998 (COPPA).

Facebook, along with most other US based websites, do not allow those under the age of thirteen to register with them as the information collected from them must be secured in a different manner from those over thirteen.

Information can be given out but permission has be to received from a parent or guardian Many sites choose simply to ban under thirteen's due to the legal issues it may present.
