Nope - normally, when a computer does a re-start to finish updating, it closes all active windows before shutting down.
If u got your 3DS before June 2011 u should go to setting then update, make sure u keep updating until there are no updates left, then the eshop is a program that comes with one update, once u update and the system restarts the icon will be there
