He may have a sore back. have a vet or horse chiropractor take a look at him to make sure.
Another thing, if earlier in his life pain on his back was used to get him to do something, he may be particuarly sensitive about his back. I read about one pony who was taught to say yes by having a nail prick his whithers. The pony was sold, and the next owner found it impossible to measure how tall the pony was because whenever the top of a measuring stick touched his whithers, he dropped his shoulders to avoid the stick touching his whithers.
