The people who design the video game covers???? All games are sent to ESRB before the final product is released. ESRB tests the game out and gives it it's final review. They're like movie critics. What Halo 3 got stands so it doesn't matter.

It is a shooting game, so it makes it a violent game. Violence is a common reason for a game to get an older ranking. However in the regular campaign the language is not near as bad as thought to be. There are no F words that I'm aware of. If it where up to me I would rate this game T+ (15+) if that were a rating.

As with all the Halo franchise games, Halo ODST is rated M for Mature because of the intense violence. While there may not be as much swearing in ODST as some of the other games, even the word "hell" is considered a swear word by ESRB (ESRB is the company that rates Video Games all the way for E for Everyone, to Ao for Adult). There is also the drama depicted in every Halo game. If it were only for the violence, ODST may have been rated T for Teen. But because of the added swearing and drama, ODST has to be rated M for Mature.
