In Furman v. Georgia, 408 U.S. 238, (1972), the Court invalidated existing death penalty laws because they constituted cruel and unusual punishment in violation of the Eighth Amendment. On November 2, 2004, the state constitution of Georgia was amended to ban same-sex marriage. That ban was struck down on June 26, 2015.
