The answer is usually no. The criminal will likely have to file a petition for habeas corpus arguing that since the law has been repealed or overturned he is being detained unconstitutionally, but these are rarely successful. The both the state supreme courts and the federal Supreme Court, as well as state legislatures and Congress, can expressly declare a new law to be retroactive, but this is extraordinarily rare. There is much more detail to all of this, but if you are really concerned, any criminal or constitutional lawyer should be able to give you some good advice.
