Actually - you have no legal authority to retain someone else's credit card. Even if the card has been declined, it's still the customer's property - and you refusing to return the card could be seen as theft ! The card company can obviously block the card from being used, which will prevent the customer using it to make purchases (which is why it would be declined at the point of sale).
