Bankruptcy is a FEDERAL law, in a FEDERAL court...the State you filed in makes little difference. Didn't you notice that on your obvious last time through...all the documents say something like "US Federal Bankruptcy Court for the District of XYZ"? No? What a surprise...maybe if you don't see how it beenfits you right then, you don't think its important.

Under the bankruptcy laws effective on October 17, 2005, Chapter 7 cannot be filed unless the debtor was discharged from the previous Chapter 7 or bankruptcy more than eight years ago.

The debtor cannot file a Chapter 13 unless: (1) the debtor received a discharge under Chapter 7, 11 or 12 more than four years ago; or (2) the debtor received a discharge under Chapter 13 more than two years ago.

That's only a very small part of an answer to your question...the real one being: Until you substantially change your ways....likely just about everything in your spending habits and probably even how and what you feel you deserve from others and yourself....you'll just continue being a bankrupt... Hey...wake up...what your doing...what your taking from others...it obviously ain't working for you and certainly ain't making you rich. Change. NOW.

When you are still married you do not qualify for the single filing status unless you have a legally recognized separation by your state.Do you have a qualifying dependent child living with you and sleeping in your home for MORE THAN 51% of the nights in a year and your spouse did not live in your home during the last 6 months of the year you may be able to qualify for the head of household filing status. If you are married, you usually must file a joint return to claim the EIC. In that case, you may be able to claim the EIC. If you filed a Chapter 13 in California and now live in Texas can you dismiss that case and file a Chapter 7?

No. Bankruptcy is not a state governed court. All bankruptcies are filed in Federal Courts. Once the Court has made a ruling it will stand. The judgment is valid in All 50 States. Sorry. Yes. Many states have opted out of federal bankruptcy filing, some states allow the petitioner to choose whether they want to file a state or a federal bankruptcy. The best choice obviously is the one that is most advantageous for the petitioner. A chapter 13 can be converted into a chapter 7 if the BK petitioner can show the trustee that they cannot meet the requirements for the original 13 filing, regardless if it is a state or federal filing. Because of the strict exemptions allowed in a Chapter 7, it would be prudent to seek legal counsel before taking any action.

If you filed a chapter 13 in Texas and now live in Mississippi can you file a chapter 7?

Bankruptcy is Federal, not state. While your state of residence changes which federal district you are in, it does not change your eligibility to file.

After 10 years could you go back into bankruptcy?

Yes, after a bankruptcy has been discharged (a 10 year period if chapter 7 was filed), the possibility of filing bankruptcy again is open. If you live long enough, you can file several times. This gives new meaning to the phrase, "Live long and prosper."

If you married in Alabama and live in AZ where do file for divorce?

Generally speaking, US states require that the party filing for the divorce actually live in the state where they file. In your case, that would apparently be Arizona. If you have more than one residence, it can get complicated. However, since you're going to be seeing a lawyer anyway to do the filing, they can evaluate the specifics and inform you if you need to file elsewhere.

How do married people file taxes if they do not live together?

Whether they live together or not is unimportant. As long as they are married they have the right to file jointly BUT DO NOT HAVE TO. It is an option that can be chosen or changed every year to each filing separate returns.

How long after a chapter 7 bankruptcy can you file another chapter 7in the state of Tennessee?

Bankruptcy is Federal jurisdiction, therefore, the state has nothing to do with it. Usually, when you file bankruptcy, you cannot file for another 7 years, Period. No matter which state you live in.

Do you have to claim married on your tax return even if you are?

You cannot file as single. You can file as married filing jointly or married filing separately. In very rare circumstances, you can file as head of household if you did not live with your spouse for even one day during the last six months of the year (and this was not a temporary absence with intention to return) and meet the other qualifications to file as head of household.

File an Extension for State Taxes Too?

If you require an extension on the filing of your taxes, do not forget to file an extension for state taxes too. Of course, if you live in a state like Florida that does not have a personal income tax, then you will not need to worry about filing taxes at all. In a majority of other states filing an extension is essential. You may incur certain fees or expenses if you fail to file an extension for your state taxes. Be sure to research the requirements for your state on receiving an extension for the filing of state taxes.
