During a lifetime in law enforcement I have investigated M-A-N-Y rear end accidents. Unless the car in front of you suddenly moved in reverse and ran into you, YOU will be found At Fault. How is it possible for YOU to run into someone due to THEIR negligence? The negligence lies with the striking vehicle (i.e.- Following too close for conditions - Failing to give full time and attention to your driving - Failing to have your vehicle under control.) Take your pick.
Obviously the person driving behind you would be at fault.
It depends on the situation. If you stoped short and got rear ended it is your fault. But if you stoped becasue the driver in front of you stoped then it is that persons fault. If you are sitting at a stop light and get rear ended it is there fault. If you are parked in a parking zone and get rear ended it is there fault. Hope this Helped

The person that rear ended will probably get hit with a following too close (if they weren't they would have noticed the other vehicle slow down or stop) and an At Fault Accident and the car that got rear ended would probably get an equipment violation for their brake lights out.
I am not familiar with California laws but... In 99% of cases, the person who rear-end's you is at fault. If the other person is at fault, they are liable for damages and medical injuries. The fact that you are not insured does not make the at fault driver not responsible for damages and injuries that he or she causes.
In New Jersey it is the driver who rear ended him who is at fault. However, that does not mean that the illegal unlicensed driver will not face deportation.

If the car that rearended you without being hit by the third car first then the car in the middle is at fault for your damage and the third car is at fault for the damage to the rear end of the middle car. The first car is not at fault for the quick stop.
The police usually give a ticket to the person who got rear-ended. If they have insurance, the insurance company sometimes do an investigation to determine who was at fault for insurance purposes. Also, personally I would obtain an attorney who specializes in traffic law and ask their professional advice.
