it is doubtful that he could return to this 1978 accident and collect from it for his state of healt now.....the longest statue of limitations i am aware of is 10 years
The claim will be made against your insurance and the company will decide if they will pay it. If they do, your rates will increase. If not, the responsible party will have to pay for the damages.

If you didn't have the Sister listed on the policy as a driver the company can deny the claim for material misrepresentation. Then you will have to pay the claim yourself.

If you are both on the same plan and one of you is paying the premiums, whoever pays the premiums will see an increase in the plan premium if the was brother at fault in the accident. Each brother should be on his own policy and pay for his own coverage.

Your brother is the only person, in this case, who can be sued. Unless you were in the car and your brother accuses you of distracting him on purpose, you can't be sued and should have nothing to do with this case. Also, be prepared for the insurance company to drop your brother from the policy - it doesn't always happen, but be prepared. This is why they make lawyers.
