You can certainly perform background checks on potential employees in most states. New Jersey and Pennsylvania are exceptions. My recommendation would include asking prospective employees to fill out a waiver to allow a background check. That way you are protected and anyone who won't allow a background check is probably someone you wouldn't hire anyway.

It is smart do a background check on a housekeeper before trusting them inside of your home. Asking for a list of names and numbers of satified clients can prove to be helpful.
