If the immigrant has a spouse who is already a naturalized or born citizen of the United States, they may only need to wait 3 years, instead of 5 years, to apply for naturalization. Immigrants should study the various forms that must be filed for different reasons, such as the N400, I-94 and I-485. These forms pertain only to immigrants and are required by law, regardless of whether the immigrant is aware or not.

Immigrants who initially entered the country illegally may still be able to obtain citizenship, but their process may be more difficult. The government treats illegal immigrants suspiciously because the way they entered the country was through breaking the law. Those who have received criminal charges while here, especially fraud, may be subject for refusal. Deportation is granted in some cases and those who have family members convicted of fraud may also find difficulties in gaining the proper paperwork for a Green Card. Illegal immigrants may be required to return to their home country and then file the necessary paperwork to enter the USA legally - then they will be allowed to file for a Green Card.
