No. You cannot cancel a contract when you have signed up for it. You have to keep paying every month until your contract finishes. Then you can either upgrade if you can (it depends on which carrier you are on.) or you can buy a new phone.
The majority of phone companies will usually offer you a 'free' upgrade within the final month of your contract. They do this for two reasons... (1) they keep you as a customer and (2) they tie you into another lengthy term (usually at least 12 months). If you're happy with your phone - you will usually get a much cheaper monthly tariff by keeping it - rather than getting a new phone. Every new 'free' phone you get is paid for - by a higher monthly payment !I have had the same phone for a few years - when I first got it (3 Mobile) - I was paying £12 a month on an 18-month contract. When I renewed my contract (for 12 months) - they dropped my monthly payment to four pounds just because I decided to keep the phone !

It is up to you. A contract means you can get the phone for free, and get a new one when the contract renews. Non contract is when you have to buy the phone up front and put a PAYG sim in it

No, you don't need a contract. You can get a pre-paid phone which means no contract/monthly phone bill, but it depends what you mean by "getting a phone". If you already have a contract and just need a new phone than u can just buy a phone but you will have to pay full price for it unless you have upgrades. If you're a new client than yes you would either have to sign a contract or you could just get a pre-paid phone.
