Most of the punishments toward an offender are set and clear. A Magistrate delegates by helping free up smaller cases from district judges by dealing with smaller offenses. Magistrates are limited to the jurisdiction of their city, and they have the authority to send offenders to jail, bail and bond hearings, charge fines for crimes committed, dismiss cases, and release offenders on bail. Magistrates can also serve as a Justice of the Peace during a wedding ceremony. Magistrate judges are usually elected or appointed by the majority vote of district judges.

To become a Magistrate of the court, a person must have a law degree from an accredited university, and must have been an attorney or a lawyer for more than ten years before applying to be a Magistrate judge. People who become Magistrates of the court will need to be over the age of twenty seven, but under the age of sixty-five. They must be able to pass a background and credit check. Have common sense, good character, integrity, fairness, and have a local knowledge of their communities. They will serve terms of eight years for full-time, and four years for part-time. They can also be reappointed. Depending on the city and state, a Magistrate judge can earn around $93,000 a year.

To apply to become a Magistrate judge, a person can apply through the web page of the district federal court, or they can pick up an application at the federal courthouse in their city. Applications are critiqued by a judicial review committee that are made up of attorneys and citizens of communities. The judicial committee will choose the most viable candidates for the job and then contact them for an interview. The interview will take place in front of the whole committee, where they will ask questions about their work history and educational backgrounds. Some questions may be geared towards answers that will help the committee to see how a person would do if they were appointed to the bench.
