How does the Constitution divide power between the three branches?

The constitution divides up the power between the three branches with checks and balances! Each branch of government get its own powers and has checks on the other. This way the power of the branches are balanced. This system is called Checks and Balances. They use this system so one branch doesn't get more powerful than another. They didn't want America to be in the situation it was in when it was under the control of great Britain where on branch of the government got too powerful!


Is the use of the Presidential veto an example of checks and balances?

Yes. The framers wanted to make sure that the Legislative Branch could not become too powerful by creating the veto power for the president. However, the President's veto can be overturned with a 2/3 majority vote from both houses of congress. Also, the supreme court can overturn any legislation during a process called Judicial Review, limiting the power of the other two branches.


Why was a system of checks and balances created?

A system of checks and balances divides power and responsibilities between several groups or people to prevent the abuse of power by one person or group. For example, in the United States the Legislative branch passes laws which must be approved and implemented by the Executive branch, and finally the Judicial branch has the power to declare laws either Constitutional or not. Many businesses use checks and balances to ensure that their finances are handled correctly.
