During the republic the senate would propose a law, which was always subject to a veto by one of the tribunes. During the principate, the emperor would enact the laws sometimes giving the senate the opportunity to "rubber stamp" it.

Rome did not have a law-making council. During the 244 years of the monarchy the kings issued the laws. During the 482 years of the republic the consuls proposed bills to the vote of the Assembly of the Soldiers or the Assembly of the Tribes and the plebeian tribunes proposed bills to the vote of the Plebeian Council. During the 506 period of rule by emperors the emperors issued laws. The Roman senate was not a legislative body. It was the advisory body of the king during the monarchy and of the consuls (the two annually elected heads of the Republic) during the period of the monarchy. During the period of rule by emperors it was emasculated.
