There was a special court for Murder and a major crime such as treason was tried in the senate. The senate would also try lawsuits, especially those brought about by the very wealthy.

∙ 10y agoAlthough many aspects of our laws have their roots in ancient Roman law, the courts were not the same as ours. An official called a praetor was in charge of the courts, with different praetors having jurisdiction over different types of litigation. For example, there was the praetor peregrinus who handled legal matters having to do with foreigners and the praetor urbanus who handled civil cases among citizens. (he was also in charge of the city and the public games, but this question is about the courts, not about praetors), in addition there was a praetor quaestiones who dealt with criminal proceedings. Any of these praetors could appoint a "iudex" or judge to preside at a trial. Roman justice was swift. If a person were found guilty, the sentence was carried out immediately, or at best in a day or two. Roman justice also depended upon class. An aristocrat who was on trial could be tried before the senate.
