It all depends on the crime. If the matter were nothing but a petty dispute between neighbors a tribune could advise them and settle their problem without going to court. If the matter were of a criminal nature, then a praetor made the decision to free or fine. If the matter concerned the welfare of the State, or if charges were brought against an aristocrat, then the Senate made the decisions.
