I found a apartment, paid money down on it #500.00. Change my mind 4 days later. The move in date was on Aug 1,2009. He had 1 month and 2 weeks to rent the place out. It's not like he would have lost out. He now refuse to give my money back. And i don't sign anything but the application , which don't have anything on it about nonrefunding money. That is the only paper i sign. There were no lease , no paper work at all. Just the application and a hand written receipt. Now he is saying that i sign a agreement. But i don't sign anything. He mailed me a copy of what i sign. But i don't open the letter yet. Also it don't have a return address on it. He can say that i had that agreement all the time. I want to save this and take it to court unopen or open it. Now he can say that i put it in that envelope if i open it. Can i sue him for forging my name. This man have kept other people deposit money in the past. I found out on the reviews on the internet. Also i talked to a person that had rented from him in the past. But the killing part about it is that he is a city insecptor. That is why he think that he can get by with this. This man has to be stopped taking people money like that.... That really took me down when he took my money like that. For 2 days i cryed. Hopeing someone can help me. runningon2

Tenant never switched gas into their own name. The landlord paid the bill for 7 months and then stopped. What are the tenant's rights?

If the lease agreement states that the tenant should switch the account to their name and pay the gas bill then the tenant should pay the landlord back. If there was no written agreement, or understanding, that the tenant pay the gas bill then you could try filing a complaint with the town, housing court, landlord-tenant agency, etc., if the landlord simply stopped providing heat and hot water. If the understanding was that the tenant pay their gas, they never switched the account to their name and the landlord didn't notice for seven months, then the tenant should start paying the gas bill and hope the landlord doesn't sue them for all the prior gas charges.

Can a commercial landlord turn off electricity that he is supplying to a tenant if the tenant has not paid utilities?

Not unless the landlord has followed your state's laws regarding disconnection of utilities for nonpayment. Any landlord who disconnects the tenant's utilities (except temporarily for maintenance purposes) without following these laws will be guilty of constructive eviction. A constructively evicted tenant can sue the landlord for moving expenses and damages.
