Go to "Settings" then "General" and find "Wallpaper". You can then choose from pictures saved to your device or one of the pictures that comes loaded on your iPod Touch by default.

Downgrading your iPod Touch should not delete anything.
You cannot delete the legal information in the settings on your iPod Touch.

It will delete music from iPod Touch, but the regular iPod i don't know about.

If you mean the wallpaper then you have to download a wallpaper app then download the shelves wallpaper you like from there. Then go into settings and select it as you wallpaper
