The oil should be changed before it get to the chocolate colour as it then indicates the clutches in your transmission are burning and not engaging properly causing damage. Per the service booklet for your W220 on page 15, it should have been changed at 40k miles from new. If you have not had it done yet, your vehicle has not been serviced correctly, and you should take it to a different garrage!
