yes you will get tested. my husbands been going through it for a while. my advise just dont do anything
This type of activity when not on probation is a chargeable offense, but probably does not mean jail time. Same would be true while on probation.
You will be charged with driving while your license is suspended. Whether or not you're on probation doesn't effect this particular offense. If you were on probation, driving with a suspended license is probably a violation of your probation, and a whole different issue.
If you are on probation for a felony and commit the same crime it is a felony. If you are on probation for a misdemeanor and commit the same crime it usually will be a misdemeanor. The exception is in some States a third misdemeanor offense for the same crime can be prosecuted as a felony. For example Stealing 3rd Offense or third offense for driving while revoked. This differs from state to state.
Your felony probation will be immediately revoked and you will be remanded back to prison. In the meantime you will be tried for the felony you committed while on probation and then face sentencing and prison time for that offense also.
If you got into criminal trouble before you were on probation. You would be in jail and not on probation. Probation is for if you are not in jail. They can't happen at the same time.Unless, you are picked up while on probation, but that would be a violation of your probation which we would be very quickly revoked.Added: The question is worded very unclearly. Probation is a sentence for being found guilty of a criminal offense for which you were charged and brought to court. It is a very lenient sentence, but it IS a sentence nonetheless. If you violate the provisions of your probation you can be taken into custody for VOP and the judge will make a decision as to whether or not you will be punished for the VOP and, if so, in what fashion. If you re-offend (commit another offense while released on probation) you will have your probation revoked AND you will be charged with the new crime.
"Poss cont subs-probation" likely refers to possession of controlled substances while on probation. This situation occurs when an individual, who is under probation for a previous offense, is found to be in possession of illegal drugs. Being caught with controlled substances during probation can lead to violations of probation terms, potentially resulting in additional legal consequences such as incarceration or extended probation.
If charged with a new crime while already on felony probation the likliehood is 100% that you will be 'violated' and returned to jail/prison, not only to serve the remainder of your sentence while incarcerated, but also to await prosecution for the new offense.
Yes I was put on probation for first DUI they do drug test and charge for your drug test if you fail you have to keep taking them until you pass or go to jail for failing your urine test. Take AZO and drink water plenty of water. But yes they drug test you almost every time.
It's quite likely your probation could be revoked and you may be sent to jail to finish the remainder of your sentence, while you are also being prosecuted for the new offense. Talk to you PO.
You should be asking what happens if you violate your probation, because the same sanctions will occur for whatever reason you violate your probation. You will be arrested and returned to court to address this violation of probation. The punishment can range from a warning to complete revocation of your probation and incarceration.
First of all, you would not be awarded PROBATION - you would be granted PAROLE. The length of time depends on many factors, including the facts of the offense - your past record - your conduct while in prison - and, how many persons testify against your being released at the parole hearing-
I would definitely recommend NOT doing so without first getting a ruling from the judge that gave you the probation sentence.
