the "Naruto" carachters that are capable of using the mangekyou sharingan are Sasuke Uchiha, his brother Itachi Uchiha, Madara Uchiha (Tobi in the Akatsuki Organization) and, in the past, his brother Izuna Uchiha. and, even though he is not part of the Uchiha clan, Kakashi Hatake, who received it from Obito Uchiha.

It can't be Madara because in recent manga chapters Madara has been revealed to be kabuto's secret weapon among the people he resurrected using his impure resurrection technique. It is Madara Uchiha, the person that would be the first hokage, but he loses his battle and the honor of the Uchiha. (Orochimaru has got his body, so he takes the body of Obito, the uncle of Sasuke, that gives his sharingan to Kakashi) Obito's face is deformed so he takes a mask.
Is madara Uchiha dead?
Yes, and no. He died after he finished training Obito Uchiha - he disconnected himself from the statue of the outer path, which was keeping him alive. Kabuto revived him later on using Edo Tensei. So he's in a sort of unlife at the moment, not truly alive.

They are different people. Madara saved Obito from death and trained him to carry out his own will, using his name. So Obito used the name of Madara since it's name the other shinobi villages could not ignore. However initially he was introduced as 'Tobi', as an Akatsuki underling.
Are Madara and Tobi the same?

Yes. Tobi's identity was finally confirmed in issue 599 of the manga, as Kakashi's old team mate, Obito Uchiha. med by himself and several other characters. (such as Itachi and Kisame). That may be true (I believe it). But you also got to look at the evidence hidden. First off Tobi's teacher, the fourth hokage, uses teleportation jutsu, and Tobi has somehow improved that jutsu by dodging and escaping everyone's attacks. His right eye is only shown through his mask and that's the eye obito didn't give to kakashi. Now i don't know this for sure but something, or someone, along the way, when the enemy ninja used their earthquake techinique and left obito buried in rock, might've saved his life (use your imagination, they might explain it later on). Oh and of course Kishimoto wants us to figure out that he is obito because the name's closely related to Obito, it's not to challenging to figure out because it would be harder to explain when he DOES explain why he picked that name.
