Yes they are, to some degree, I build concrete slabs and foundations for a living. I can tell you after we pour the slab and it has cured, after a day of walking on it my feet and ankles are pretty sore. I have gotten shin splints as a result of it one or two times also. I don't think its bad for your back, as I have never had any problems with mine, but I can say it definatly puts strain on your feet.

Hire a lawyer. Have a sample investigated by a lab. However, doing this will likely cost more than just replacing the concrete. Unless they delivered A LOT of bad concrete.
