They will garnish your future SSA payments until the debt is paid back.
It depends. Any overpayments or funds received by fraud from any state or federal agency cannot be discharged in a Chapter 7 bankruptcy, or in a Chapter 13 bankruptcy filed on or after October 17, 2005. If the overpayment was not the result of fraud, it will be discharged. See the case of Lee v. Schweiker, 739 F.2d 870, 874 (3d Cir. 1984). SSA or any other government agency must prove, in the bankruptcy court, that the overpayment was the result of fraud. If fraud is proved, the overpayments will not be discharged in bankruptcy, and SSA can recover the overpayment from any future benefits. Please be advised that the SSA has the option of filing a civil suit if the amount is large enough, and can file federal criminal charges if the benefits were obtained fraudulently.

Yes, usually SSA will keep a portion of your disability benefits until the overpayment is paid in full. If you're in an overpayment, you might try applying for a waiver.

SSI underpayed me upon my SSI award. And withheld $3,581.70 alledging an past overpayment. However; upon request for waiver. On Aug. 22 2011. A decision was rendered at a formal ALJ hearing By the honorable ALJ Judge Weir III. Whom granted my request for a waiver of alledged overpayment. Documents confirm ALJ ruled that I wasn't at fault and waived the collection of an overpayment. However, a month has passed. And I have yet to receive any notice from SSA in regards to my refunded claim of $3,580.70 When can I recover my refund of alledged overpayment already collected.

You could appeal their ruling if you were not overpaid. However, if you were overpaid and do not now qualify for ssa or have to pay some back then no.
