There is no legal direct tax in America. The 16th Amendment, which is often used to justify direct taxation, was ratified in the year 1913. Article 5 of the US Constitution states that amendments can be made "Provided that no amendment which may be made prior to the year 1808 shall in anyway change clauses 1 and 4 of the 9th section of the 1st article" Where the word may means across the board that "the government can do it but doesn't have to." This includes the Income tax, property tax, and every other type of government mandated spending for the people.
