∙ 10y agoAfter the battle in the Department of Mysteries at the Ministry of Magic in 'Order of the Phoenix', Lucius and the other Death Eaters present are captured and sent to Azkaban until sometime between 'Half-Blood Prince' and 'Deathly Hallows', when they're set free to work for Voldemort. However, none of the Malfoys are sent to Azkaban at the end of 'Deathly Hallows' due to Harry confirming their change of allegience (Narcissa Malfoy lying to Voldemort about Harry being dead, and her and Lucius' refusal to fight in the Battle of Hogwarts, instead running around screaming for their son).
