The Gold Rush of 1849 was an important first step in California's path to statehood. It brought large numbers of American citizens and new immigrants to California. California quickly became vital to the United States and the region was granted statehood in 1850. California never was a US territory. It quickly passed from a Mexican territory to an independent military region to a state without a country until it became the 31st state in 1850.

Eugene H. Cota-Robles is an emeritus professor of microbiology at the University of California, Santa Cruz. Aside from his contributions as a researcher he was very active in recruiting minority students to apply to and study at the University of California from the earliest days of his career. In recognition for his contributions towards increasing diversity at the University of California the Regents named the University of California GPOP Fellowships after him (search on "Eugene Cota-Robles Fellowship Program" at any UC campus). He was born in Nogales, Arizona in 1926 to Mexican American parents, served on the heavy cruiser Baltimore during WWII and did his undergraduate work at the University of Arizona. A territory could not apply for statehood if it did not meet certain criteria established by Congress, such as having a sufficient population, a stable government, and the ability to uphold obligations and responsibilities of statehood. Additionally, the conditions of the Northwest Ordinance of 1787 specified that territories needed to demonstrate readiness by establishing a constitution and governance structure. Furthermore, Congress retained the authority to determine whether a territory could qualify for statehood based on political, economic, and social factors.
California's rapid transition to statehood was primarily driven by the Gold Rush of 1849, which led to a massive influx of settlers seeking fortune. This population boom created a pressing need for governance and infrastructure, prompting California to draft a constitution and apply for statehood in 1850. The political climate of the time, particularly the Compromise of 1850, facilitated California's admission as a free state, further reflecting the urgency of integrating the new territory into the Union amid sectional tensions.
A territory can become a US state through an act of Congress. The territory must first apply for statehood and then go through a process to draft a state constitution. If Congress approves the statehood petition and constitution, the territory can be admitted as a new state.
The Gold Rush made the population of California grow immensely. It was the sole reason why California was able to apply for statehood.
A US Territory or as with Puerto Rico, a US Commonwealth, can apply for statehood into the United States first by a vote of the people in the territory. The US Congress accepts the finalized application. The territory, as one condition for example must have its own constitution.
An act of Congress granting statehood is typically known as an Enabling Act. This legislation outlines the conditions and requirements for a territory to become a state. Once these conditions are met, the territory can draft a constitution and apply for admission to the Union.
California took several key steps to apply for statehood following the Gold Rush of 1849. A significant early step was the convening of the California Constitutional Convention in 1849, where delegates drafted a state constitution. Following this, California held its first election and submitted a formal request for admission to the Union in December 1849. The state was ultimately admitted as the 31st state on September 9, 1850, as part of the Compromise of 1850.
