Mens rea is a law term. Basically to charge a person of a crime in Canada, the Crown must prove that two elements were present at time that the offense was committed: a. Actus Reus - the act itself; and
b. Mens Rea - the intention to commit the act Mens Rea is the deliberate intention to commit a wrongful act, where one recklessly disregards the consequences, had the guilty intention to comment the offense, or knew that the act was against the law and still did it. From what I remember, mens rea could be proven through 1. Knowledge - an awareness of certain facts (such as knowing that the act was illegal)
2. Recklessness -consciously taking an unjustifiable risk that a "reasonable person" would not take
3. Wilful Blindness- a deliberate closing of one's mind to the possible consequences of one's action I'm positive that there are more ways to prove mens rea but I just can't remember . PS. I'm from Canada, so this answer holds true for Canadian law. However, I'm not sure if it is true for others.
