Smith was killed by Native Americans in Southern California while he was heading out of the territory. A Mexican patrol found him living with the Tule lake tribe in central California and arrested him. They took him to the border. At the time it was the Mexican governments policy to remove all Anglos from California to try to prevent another Texas.
