Usually, all peace officers are sworn to uphold the law, and they are peace officers 24/7. Just because they are not on duty, does not mean that they are free to ignore violations of the law, especially if the violation is serious, either as to public safety, or for violations of other more severe illegal activities. Based on this, I suspect that an off-duty Sheriff, or Deputy, can at his/her descretion, issue a ticket for speeding or anything else he/she deems important and necessary.
