Not being a citizen is not a crime. There is no law that says only citizens can be here. There is no law that says you have to be a citizen to work or live in the United States. You do have to have a legal visa or green card to be here legally if you are not a citizen of the US or specific countries that are allowed entry without a visa.

If that person is here illegally, then yes, they can be deported.
