Any disclosure of further information what so ever is a violation of your right to privacy. If they did disclose any sort of negative information to a prospective employer you absolutely have the right to sue. And if their mistake cost you that job, then you could, feasibly, sue them for lost wages, defamation of character, intentional infliction of emotional distress, and you could, possibly, get some punitive damages too.

But an employer would be very wise to reveal early in the recruiting process that there will be pre-employment drug tests, otherwise they will lose prospects who withdraw candicacy when informed.
