In 1953, the Eisenhower administration was in the process of organizing a world wide system of military bases. Secretary of State, Dulles asked of Congress if they wished to call agreements made to open bases a "treaty" of sorts. He was giving Congress the right to have a say on when and where US Military bases could be built. The Congress, with no disputes, simply agreed that the executive branch had power of such agreements that established military bases.
Congress has been granted sovereign powers. These powers are the power to borrow money, the power to regulate Federal property, levying and collecting taxes, trade regulations, and military power.
Congress (meaning both the House and the Senate) possess the sole ability to declare war. While the President addresses Congress, he is requesting a declaration of war, and then House and Senate debate and vote. Additionally, the Congress annually votes and approves the budget for Defense Department, as submitted by the president, and they have the ability to increase or decrease the amount requested by the president.

But Congress could not collect taxes or enforce laws drectly; it had to rely on the states to provide money and enforce its laws.
There are no dissenting judges as to the power of the American military. From the president being the commander-in-Chief to the Congress controlling the budget and funding, the military is subject to civilian control.
