George B. McClellan. When you leave 2,108 men dead on the battlefield and you hold a two to one battlefield strength it is just a mite difficult to call it a victory. A pyrrhic victory at best. That is why it is most often termed a strategic victory because Lee ended the Maryland campaign and retuned to Virginia. For Lee it was not a defeat because it had been a "show of strength to attack the Yankee's on Northern Soil".
