When the Constitution was sent to the 13 states for ratification, the Bill of Rights was not included, and many states would have failed to ratify without an iron-clad promise that certain rights would be memorialized in writing later. Eventually, all 13 state legislatures ratified the original document, and the Bill of Rights was added subsequently.
