Overall, it upholds the principle of open justice, which is fundamental to democratic societies.
The Romans overthrew the last Roman king in a rebellion in 509 BC because he was a tyrant. The Romans decided to do away with the monarchy and establish a republic to prevent the return of tyranny. Monarchy became associated with tyranny. The Roman Republic was headed by two annually elected consuls. Having two men in charge meant that they could counterbalance each other. The short term of office ensured that no one could concentrate power in his hands and thus become a tyrant. The Romans also swore that they would not let anyone try to become a king. Trying to become a king was the worst possible accusation. In the 5th century BC one man was killed and his house destroyed and in the 4th century BC another man was executed because of accusations of trying to become a king. The Roman Republic lasted for 482 years (509-27 BC). It was replaced by rule by emperors.

Madison argues that dividing power is crucial to prevent any single entity from becoming tyrannical, as it creates a system of checks and balances that protects individual liberties. By distributing authority among different branches of government and levels of governance, it ensures that power is moderated and held accountable. This structure promotes a more stable and just society, where the rights of citizens are safeguarded against potential abuses. Ultimately, Madison believes that such division is essential for preserving democracy and maintaining order.
The constitutional principle that ensures elected leaders can be held accountable for their actions is the principle of checks and balances. This system divides government powers among different branches—executive, legislative, and judicial—allowing each branch to monitor and limit the actions of the others. This oversight helps prevent abuses of power and ensures that leaders are answerable to the public and the law. Additionally, mechanisms like elections and judicial review further reinforce accountability.
James Madison believed in the separation of powers to prevent any single branch of government from becoming too powerful and to protect individual liberties. Influenced by Enlightenment thinkers like Montesquieu, he saw this system as essential for maintaining a balance of power and ensuring that government remained accountable to the people. Madison's experience with tyranny and his commitment to democratic principles reinforced his view that a divided government would safeguard against abuses of power.
In a democratic society, the rule of law, checks and balances, and systems of accountability are in place to ensure that those in power are held accountable for their actions. It is the responsibility of citizens to remain informed, advocate for transparency and accountability, and participate in the democratic process to safeguard against abuses of power by those in positions of authority.
The consuls held most of the power.
