In Henry's time almost everyone in Europe including England practised the Roman Catholic faith which made divorce illegal. Royalty could, however, petition the Pope in Rome to seek an annulment to their marriages on certain grounds ie the marriage had not been consumated.

When the Pope refused to annul Henry's marriage to Catherine. Henry passed the Act of Supremecy making himself head of the English Church.

Thomas Cranmer, Archbishop of Canterbury was then able to annul the marraige.
