A nonresident alien is an individual who's neither a U.S. citizen nor a U.S. resident alien. Form 1040NR is U.S. Nonresident Alien Income Tax Return. Form 1040NR-EZ is U.S. Income Tax Return for Certain Nonresident Aliens With No Dependents.

A nonresident alien's income that's subject to U.S. income tax is divided into two types. One, income that's effectively connected with a trade or business in the United States of America. Two, income that's not effectively connected.

The first type, after allowable deductions, is taxed at the same rates applying to U.S. citizens and residents. The second type is taxed at a flat 30 percent rate (or lower if there's a treaty agreement with the individual's home country).
