Level I & II prescriptions should not be an issue, but if you are talking about Schedule 3 level, which are narcotics, etc, you would have to check to see if you need a court order.

Is there anything in Colorado law that says a parent who is taking prescribed pain meds can not get custody of the kids in a divorce?

As long as the meds are being taken as prescribed and for legitimate purposes, and not being abused, then it should not affect your chance of getting custody. But if you are abusing them, including 'doctor hopping' by going to multiple doctors to obtain the prescriptions, then yes, it absolutely can affect your chance of gettting custody of your children. Also, depending on the type of pain meds, you should never drive while you are taking the meds, especially if your children are in the car with you. Otherwise, this could result in you losing custody of your children, too.

They, also, will be able to tell you if they have the individual in custody.

Can hair follicle drug testing be court ordered in a custody battle?

Yes it can. Actually I was just in court yesterday and my ex was ordered to have a test done. I do not believe that it is common but we currently have joint custody and I am fighting for full custody. My ex works in a hospital along with his girlfriend. My 12 year old son found vials of morphine in his drawer- that is a drug that is not prescribed but given in the hospital. I asked that he be drug tested. We will now wait and see what the results show.

If you have sole custody and your ex has physical custody can you keep her?
