It depends on the state to an extent. It is my understanding that you cannot be bound by an agreement that does not allow you to practice your profession. In my area these agreements were used in the past and were found unenforceable. It also would require the other party to expend a considerable effort in time and money to attempt to enforce such an agreement. Just be sure you know the personality you are dealing with would be my recommendation. I would pay an attorney for a consult just to be safe.
