Uploading is illegal if you upload a file to a server that does not ordinarily permit you to do so. Once you do that you have violated the terms and agreement of the use of that server.

So, if you are allowed to upload files to a particular server than it is not illegal. Anything else would be illegal.

One other thing; uploading a file with intent to distribute it to others on a copyrighted file would also be illegal.
