also to mention: My husband of 7 years is going for full custody of his 10 year old daughter. His daughter is currently staying with us since the mother in in jail for drug charges. She is frequently in/out of jail for drug and alcohol charges. His daughter has often complained of domestic violence between mother and boyfriend, drug use in their house and having to move every 4 to 6months. My husband and I have children of our own that are also worried about his daughter since she always asks to live with us. We are going to trial soon and hope to be awarded custody...but sometimes it seems that the court favors the mother. I understand that the child is not old enough to choose for herself on where she would like to reside...so what can we do? Even with all the evidence against the mother...is it likely we could not gain custody? Thanks for any incite.

Your husband simply must prove that his ex wife is an unfit mother as evidenced by her pattern of behaviour.
