They will usually serve the petition within 2 days of you presenting it to them for service; provided they can locate the respondent. 2. Service by publication. This is usually reserved for cases where the repspondent can not be located. It involves a posting at the couthouse door and/or publication in a newspaper. 3. Waiver of Service - This is when you and your spouse both agree to the divorce and he/she will sign a waiver of service. basically you hand them petition to your spouse along with the waiver of service, he/she signs it and you return it notorized to the clerk of the court. In my opinion, its far better to use the sheriff's office. They will file the form where they have served the respondent with the clerk of the court and its nearly irrefutable in court.
