You cannot really sue your landlord for unfit habitation. If your rental unit is deemed unfit for habitation you may simply move out. If you are in the middle of the lease, and the dwelling is unfit for habitation, you have the right to move out under what is known as constructive eviction, meaning that you are abandoning the premises because you cannot live there. Your landlord may try to keep the security deposit if he is holding one for you. You must then sue the landlord to reclaim it.

Lease says that landlord is responsible for lawn mowing. Landlord will not honor this. Can lease be broken by tenant?

Yes he can. A violation of the terms of a lease by a landlord is just as much grounds for termination by the tenant. The landlord can still evict you but less likely will win.

Can a landlord evict a guest for a noise complaint if the tenant was causing the noise?

Yes. If a tenant is not in the habit of making a lot of noise then the landlord would not have much grounds to evict them. However, if a tenant is a problem for other renters, how a landlord evicts someone depends on the state in which he lives. Usually, a landlord could evict a person even if they have a lease for violating city codes for noise. A landlord would be wise to put such stipulations in their leases. This is based on the number of complaints the police receive concerning the noise or the number of complaints a landlord receives. In some states, all a landlord has to do is send a registered letter to the tenant notifying them of the complaint and that they are on notice to cease and desist or face eviction. If the tenant continues to bother others with their noise, then the landlord can notify the Sheriff's Department to evict the tenant. Of course this will not prevent the tenant from taking the landlord to court. This is why the landlord needs to keep good records and copies of police reports concerning the tenant to use in court.

If a tenant put up showers in there place and there having trouble with them now who is responsible to fix it?

The tenant is responsible for what ever they put up in the unit, first they need to ask the landlord if they have permission, it is a much better idea that the landlord should make all the necessary changes, that way the tenant does not have the responsibility nor the costs. If the landlord declines and the tenant goes ahead anyway, the tenant can leave themselves wide open to be sued for damages if anything goes wrong.

What is a tenant estoppel agreement?

A tenant estoppel agreement is between the seller of the property and purchaser, which may have specific terms, such as the terms of the lease for that tenant - for example, the condition of purchasing the property is that the new landlord will honor the terms of the lease originally written by the old landlord - a list of tenants in each unit of the property, and how much rent each tenant is paying.

Is a person in abandonment if they are arrested and can the landlord keep their possessions?

The landlord is required to make reasonable attempts to notify the former tenant that he must remove his possessions. How long the landlord must wait before he disposes of the items depends on how much time the tenant has paid rent for. The time also depends on the jurisdiction.

Can your landlord use an air-horn for noise control?

No tenant should focus on how a landlord can stop them from behaving badly. They primary concern by far should be their own actions. A landlord can and should control noise so start with that in mind. A tenant should not make so much noise that the landlord needs to act. Using an air-horn? It depends on the circumstances and who is bothered by it. If it interferes with others or interferes more than the tenant's wrong behavior, then maybe not. I can't imagine anyone sympathizing with the tenant in this circumstance.
