The death penalty was used as a deterant, to send a message that certain crimes carry the ultimate punishment. In 19th century America stealing a horse was punishable by hanging. It seems impossible that people were actually hung for stealing a horse.

Things have changed reguarding capital punishment. Most places a prosecutor can ask for the death penalty only if the crime was 1st degree murder with special circumstanses. Some states are reluctant to inforce the death penalty, for example California has many prisoners on death rows yet the state hasn't executed anyone for quite some time. Other states such as Texas, Georgia or Florida execute far more prisoners.
