The driver does. You can't just look at the officer and say, "Oh, it's not mine". You can't have anything containing alcohol that has been opened in the front of the car. If you need to drive with a previously opened bottle of something for example, you must put it in the trunk or risk getting caught.

In Michigan it doesn't matter, they'll ticket everyone in the car, whether you were drinking or not, and it's 8 months probation and random testing, community service, and drug abuse classes for a first offense no criminal record and no concern for drug abuse. Never move to Michigan if you want the law to treat you fairly.
