How can i tell if a drive way is legal or not? i live in New York city on a block where there are more than 10 drive ways and some of them look suspcious i parked in front of a drive wayand i was threatned with being my car beeing towed away please help me find witch one is legal (edited by Jennifer sule and i say i think the driveway has to be gated and signs posted that stated that if you park there that your car will be towed. otherwise that is NOT a legal driveway. this is waht a cop rtold me tonight as i live in Brooklyn and just had to fight to have a car moved from in front of what i THOUGHT was my driveway that i rent from my landlord. no gate no signs... Legal? It could be a parking violation if you block a driveway by parking in the street. In any case, it would be trespassing if you parked anywhere on private property without license or other reason to believe you're allowed to be there, let alone park there.

It is the person who is blocking the private driveway's fault because they should have known not to park in front of a private driveway in the first place. However, if the private driveway is not marked with a sign of some sort to let people know that it is private, it may be the driveway owner's fault.
If you're parking in their property e.g.: Their own driveway, garage, or a designated area which is part of their property, then yes most likely it's trespassing when you park there. However, if you park at a street which is a public street, then the only restrictions that apply are those of the local government (the state, city, town .. etc). Someone doesn't have any legal support to ask someone to not park at a public parking because it's in front of there house. Out of courtesy, however, most people don't do it. But, again, it's totally legal and as long as it's public parking (street) you can park wherever you want following the rules of parking set by the government.
